These terms govern your subscription to Vansight and your use of the lists we send. By subscribing, or by using a list we sent to your company, you accept these terms on behalf of the company you work for. "Vansight," "we," and "us" mean Vansight; "you" means the subscribing company and the people it shares the list with.
Vansight is a subscription lead list of restaurants opening soon in a named metro, compiled from public government records such as building permits, liquor license applications, food service license applications, and new business filings. We merge those filings into one lead per restaurant and send the list on a recurring schedule, along with an always-current spreadsheet. Leads marked verified have been checked against state licensing records before we send them. The early-signal scouting list contains earlier, unconfirmed leads and is always labeled so the two never blend.
Everything we send is compiled from public government records. Public records contain errors, arrive late, and describe plans that change: a project can stall, move, change names, or turn out not to be a real new opening at all, such as a ghost kitchen, a relocation, or an ownership change. The service and every lead in it are provided as is and as available, without any warranty of accuracy, completeness, timeliness, or fitness for a particular purpose. The accuracy credit in section 6 is your sole and exclusive remedy for a lead that turns out to be wrong.
If a lead we sent as verified turns out not to be a real new opening, tell us. We will credit one month at your current rate to your account. This credit is the sole and exclusive remedy for errors in the data.
To the fullest extent the law allows, our total liability arising out of or relating to the service is capped at the fees you paid us in the 12 months before the claim arose, and we are not liable for indirect, incidental, consequential, or lost-profit damages.
We may update these terms by posting the new version at this page and, for material changes, notifying subscribers by email. Changes take effect on the date stated in the notice, and continued use of the service after that date is acceptance of the new terms.
These terms are governed by the laws of the State of Florida. Any dispute arising out of or relating to the service will be brought exclusively in the state or federal courts located in Florida.
